Congress delays part of the federal hemp-product ban

On 2 September Congress passed a continuing resolution, Public Law 119-103, that moves part of the new hemp definition from 12 November to 11 December 2026. The exclusion of cannabinoids that a cannabis plant cannot produce naturally stays on 12 November, and from that day those products are marijuana under the Controlled Substances Act. The rest of the definition, including the total-THC cap and the 0.4 milligram limit on a finished product, waits until 11 December. The 2025 law that wrote the definition is unchanged apart from those dates.

Virginia ends its CBD-ratio exception to the hemp THC cap

According to the Cannabis Control Authority's implementation notice, products containing more than two milligrams of total THC per package could no longer be produced or sold as hemp products from 15 August. The change removed the exception based on a CBD-to-THC ratio of 25 to one. It concerns the hemp-product market, not a new adult-use flower possession limit.

Czechia's new government announces a tougher drug policy

Prime Minister Andrej Babiš said after a cabinet meeting that he would not run a liberal drug policy and announced 18 measures across four laws. As reported by ČTK they include cutting the THC limit for hemp from 1% to 0.3%, banning CBD products, taking kratom off sale and making some conduct a crime again. The former drug coordinator Jindřich Vobořil called it a return to before 1989. None of it had been adopted.

US Virgin Islands replace a hemp inventory freeze with a sales window

Governor Albert Bryan Jr. approved a replacement rule telling retailers to report their intoxicating-cannabinoid inventory within 60 days and sell or otherwise dispose of it within 75 days of the act’s effective date. The cannabis regulator was then to plan the lawful disposal of remaining stock. This replaced the January law’s ban on selling or distributing existing inventory until regulations and retail licences were in place.

US Virgin Islands require cannabis licences for intoxicating hemp products

Governor Albert Bryan Jr. approved a law requiring cannabis-regulator licences or permits for selling, possessing or manufacturing intoxicating hemp and artificially derived cannabinoids. It covered THCA products and specified altered or intoxicating cannabinoids, set civil fines starting at $2,500, and required age checks, independent testing and child-resistant packaging for licensed retail. Its original inventory freeze was replaced by reporting and sell-or-dispose deadlines in March.

Austria puts hemp flowers under the tobacco monopoly

The National Council passed a tax law under which legal low-THC cannabis products may be sold only by tobacconists from 2029, supplied by approved wholesalers. 1. 🇺🇸 United States Tightening ✓ Article

The US Congress closes the hemp loophole for intoxicating products

A spending law, the Continuing Appropriations and Extensions Act for 2026, rewrote the hemp definition of the 2018 Farm Bill. From 12 November 2026 hemp means cannabis with no more than 0.3 per cent total THC, counting THCA and not only delta-9; cannabinoids made outside the plant, such as delta-8 converted from CBD, fall outside it; and a finished product may hold no more than 0.4 milligrams of total THC per container. Hemp grown for fibre, seed oil and other uses that are not about cannabinoids stays legal. Lawyers expected the change to close most state markets in hemp-derived THC products and to bring litigation.

Andorra's Constitutional Court rules that CBD flower is a drug

The court dismissed the appeal of a resident who spent more than a year in prison after being caught at the border with just over half a kilo of cannabis flowers sold as CBD, and was then expelled for five years. A Monegasque man born in 1956, with a clean record, was tried for possession and use of narcotics after a search of his home found 15.62 g of cannabis, a CBD spray and CBD chewing gum. The prosecutor cited a ministerial order banning cannabis and its derivatives, including CBD, even at low THC levels, and asked for three months suspended. The defence argued that CBD is legal in the neighbouring countries. The court gave one month in prison, suspended, with two years' probation and an obligation to undergo care.
