Cabo Verde’s health regulator clarifies its ban on cannabinoid cosmetics

ERIS circular 012/ERIS-CA/2024 reiterated its prohibition on cannabis-related preparations and CBD or other cannabinoid ingredients in cosmetic products under the framework described. It warned that an inventory entry without a listed restriction did not establish permission. The circular was a regulatory clarification, not a general ruling on all CBD uses.[1]

The story

Cabo Verde’s health regulator ERIS issued a three-page clarification on cannabinoid cosmetics on 6 May 2024. It reiterated the prohibition described in its regulatory framework and warned that an ingredient inventory should not be read as a list of permitted ingredients.

The circular identifies cannabis and resin as controlled under Table II-A of Decree-Law 92/92. It addresses cannabis-related preparations and CBD or other cannabinoid ingredients in cosmetics, and places responsibility on operators to comply with the applicable restrictions.

Its scope matters: this is cosmetics guidance. It does not independently establish the legal position of every food, seed or medicine containing a cannabis-related ingredient, nor does it announce a general cannabis patient programme. The history entry records a regulatory clarification rather than a newly established blanket ban on every use of CBD.[1]
