A federal court says Washington may not deliberately subvert California's medical law

In County of Santa Cruz v. Mukasey, Judge Jeremy Fogel refused to dismiss the suit brought over the 2002 raid on the Wo/Men's Alliance for Medical Marijuana. He held that the Constitution bars the federal government from deliberately setting out to subvert a state's medical cannabis laws, relying on the appeals court's reasoning in Conant v. Walters. The ruling did not make cannabis legal under federal law.[1]
