In criminal proceedings against Edgar Babanov, the Court of Justice held that EU agricultural rules precluded national legislation prohibiting cultivation and possession of fibre hemp covered by Regulation 1782/2003. National courts could not apply conflicting prohibitions to that hemp. The order concerned qualifying agricultural hemp, not a general right to grow intoxicating cannabis.[1]
