Kyrgyzstan's top court blocks a return of the death penalty

After the September 2025 murder of a 17-year-old girl, President Sadyr Japarov proposed a constitutional amendment that would allow death sentences for child rape and for rape with murder. The Constitutional Court ruled on 10 December 2025 that the amendment could not go to a referendum because it contradicted the constitution and Kyrgyzstan's obligations under the Second Optional Protocol to the ICCPR. The death penalty therefore remained abolished, and the current Criminal Code provides no death penalty for drug offences.[1][2][3]
