The Penal Code of Bhutan, in force on 11 August 2004, created the first statutory drug offences. Sections 496–501 punished illegal cultivation or production and illegal transaction as fourth-degree felonies, and possession or use without a prescription as a petty misdemeanour, or a misdemeanour with intent to sell. A 1988 government notification had already given the police a drug-control mandate, but the 2004 code supplied the first penalties.[1][2]
