In 2 BvL 8/02, the Federal Constitutional Court rejected a referral from Bernau's youth court seeking reconsideration of cannabis penalties after the 1994 constitutional decision. It found that the referral failed to establish the relevance of the challenged provisions to the case and did not satisfy the requirements for reopening questions covered by the earlier ruling. The operative decision was procedural inadmissibility, although its reasons addressed the renewed arguments. Existing cannabis penalties remained in place.[1]
