East Bengal extends its excise law to the district of Sylhet

From 1 April 1950 the Bengal Excise Act, 1909, applied to the district of Sylhet.[1] The Eastern Bengal and Assam Excise Act, 1910, and the Assam Temperance Act, 1926, ceased to apply there.[1] Anything already done under the repealed Assam excise Act stayed in force, and Bengal excise officers were to deal with it.[1]

The story · written by grok-4.7,

From 1 April 1950 the Bengal Excise Act, 1909, applied to the district of Sylhet.[1] The Eastern Bengal and Assam Excise Act, 1910, and the Assam Temperance Act, 1926, stopped applying there on the same day.[1] Cases and other steps already taken under the Assam excise Act remained in force, and officers appointed under the Bengal Act were to carry them on.[1]

The law Sylhet was put under

From 1876 Bengal licensed ganja growers, stores and exports. Growing was concentrated around Naogaon, and the crop went through government warehouses to licensed shops. From 1 February 1931 the Dangerous Drugs Act rewrote that excise law so that bhang, siddhi, ganja and charas stayed intoxicating drugs under it. Extract and tincture of hemp were taken out of that definition and classed as manufactured drugs, which needed their own licence. East Bengal Act XII of 1950 is the statute that made this Bengal Act the excise law of Sylhet.[1]

What the 1950 Act says

The Act is dated 29 March 1950. Section 1 says it comes into force on the first day of April 1950.[1] The East Bengal Legislative Assembly dealt with it on 27 February 1950. The objects and reasons were printed in the Dacca Gazette of 8 December 1949 and again on 14 February 1950.[1] Section 10 says that, whatever any other law provides, the Bengal Excise Act, 1909, shall apply to the district of Sylhet. Section 11 repeals the Eastern Bengal and Assam Excise Act, 1910, and the Assam Temperance Act, 1926, in their application to that district.[1]

The repeal does not undo anything already done under those Acts, and it does not wipe out a right, title, obligation or liability that had already arisen.[1] A proceeding that had started under the Eastern Bengal and Assam Excise Act was to continue, and the Excise Commissioner or an excise officer appointed under the Bengal Act was to deal with it.[1]

The amending sections are missing from the reprint

Sections 2 to 9 of the same Act are marked in this official collection as repealed by the East Pakistan Repealing and Amending Ordinance, 1960.[1] Their text is not printed. Those were the sections that amended the Bengal Excise Act itself. This account therefore covers the extension to Sylhet and the repeal of the two Assam Acts, which are the sections still printed.

The licensed Naogaon trade was still going in the 1970s. The current account of the law is on Bangladesh’s profile.
