In AK Futures v. Boyd Street Distro, a trademark dispute and the first case on delta-8 THC before a US court of appeals, the Ninth Circuit held that the products could be protected as trademarks and, in passing, that they were lawful under the 2018 hemp definition. Federal courts later upheld state laws that restricted or banned delta-8, among them Virginia's and Wyoming's.[1]
