Thailand revises cannabis penalties and separates smaller supply offences

Narcotics Act No. 5 of 2002 revised category 5 penalties. Basic cannabis possession retained a five-year prison ceiling, but a fine up to 100,000 baht could now be imposed instead of, or alongside, imprisonment. New Section 76/1 set sale or possession for sale below ten kilograms at two to ten years, a 40,000–200,000-baht fine, or both; ten kilograms or more attracted two to fifteen years and a 200,000–1,500,000-baht fine. Previously, sale and possession for sale carried two to fifteen years and a 20,000–150,000-baht fine. The amendment mixed reduced imprisonment exposure for smaller supply offences with higher fines. Its weight bands did not create a lawful possession allowance.[1][2]
