A Naples magistrate had asked whether the 1954 drug law was unconstitutional because people facing forced confinement in a clinic had no right to a defence. Before the court ruled, the 1975 reform repealed that law and brought in new treatment rules with safeguards for the people concerned. The court therefore sent the case back to Naples to reconsider whether the question still mattered, without answering it (Order 224/1976).[1]
