# Ukraine: use penalties, compulsory treatment and the 1995 overhaul

Reviewed 25 October 2026. Three new events, one revised score snapshot and two
new articles. The consumption profile now distinguishes private use from the
criminal public-use offence. Current segment scores remain unchanged.

## Primary sources read

- Original **28 January 1991** edition of decree 663-XII, reproduced from the
 Rada portal: <https://zakononline.ua/documents/show/155961___155961>.
Read Parts II–VII: revised compulsory-treatment admission, hearings, appeals,
extensions, removal of the ten-day compulsory-examination sentence, removal of
use from criminal article 229-8 and administrative article 44, and ordered
releases/shorter stays. Part I concerns alcohol and is not used as evidence
of cannabis law. Do not use the current 2009 edition: relevant earlier parts
have been repealed from that text.
- Original **15 February 1995** edition of Law 64/95-VR:
Read the preamble, Part I's inserted public-use offence 229-16 and rewritten
cultivation, possession and surrender/treatment offences, and Part III's
administrative possession/cultivation rules. The original-edition link was
followed from the current page; guessing the second document ID would have
returned the wrong or unavailable page. The current version omits the old
criminal-code amendments and cannot establish their original content.
- Complete Resolution **65/95-VR of 15 February 1995**:
Paragraph 1 commences the law on publication; paragraphs 2–3 order release
 from punishment and case closures for specified cultivation convictions;
paragraph 4 expressly excludes other specified convictions. These are orders,
not evidence that a particular number of prisoners was actually released.
- Rechecked the 1987 original already read in the preceding pass:
Administrative article 44 and criminal article 229-8 supply the before/after
comparison for the 1991 use-offence repeal.
- Downloaded the Rada Criminal Code print reproduction hosted by UNODC:
Its footer identifies **7 September 2024**, downloaded from Rada on 9 September
2024. Read article 316 across PDF pp. 104–105 and its amendment note; rendered
and visually inspected p. 104. Do not call this an original 2001 code merely
because it lives in a URL directory labelled 2001.
- Read the complete current article 316 reproduction at
 <https://advoksglobal.com/ua/uk/law/criminal-code/article-316/>.
It credits Rada and states text retrieved **19 October 2026**. Its public/group
use wording and penalties match the 2024 official print: up to four years of
restriction of liberty or three years' imprisonment; aggravated three to five
years. It is a third-party reproduction of statutory text, not an independently
authenticated current Rada body. Direct Rada requests returned 403/timeouts.
- EUDA's country overview, national drug laws, expressly distinguishes private
use from criminal public/group use and possession:
It is dated **17 June 2016**. It corroborates the use distinction only; its
old possession penalties are not copied into the current profile.

Local PDF, extraction, rendered page, source metadata, checks and build log are
retained in `tmp/history-ukraine-transition-2026-10-25/`.

## Dates and factual boundaries

The 1991 and public-use 1995 events use **year precision**. Their descriptions
identify issue/adoption dates, but exact commencement/publication dates were not
verified. The 1995 resolution explicitly says publication is commencement. The
release-order entry uses **15 February 1995**, the verified adoption of the
order, and consistently says parliament ordered release, not that release had
already occurred that day. No publication-date guess becomes a full-date event.

The 1991 decree retains a two-year total ceiling after a court extension for
systematic misconduct inside an institution; its six-to-twelve-month ordinary
period is not an absolute ceiling. It requires public-order/others'-rights
violations in the revised admission wording. The article does not claim every
person who used cannabis was eligible for compulsory treatment or that treatment
institutions disappeared. The general use offence was removed; separate drug
possession and supply offences remained.

The 1995 grow reform is more complicated than a blanket pardon. The new law
retained criminal repetition and aggravated cultivation, including the 500-plant
band and supply-related circumstances. The release resolution covers old
article 229-3(1) and its repeat-offence form in part 2, while expressly excluding
old article 229-9 and specified other article 229-3(2) convictions. Public prose
keeps these separate and avoids calling all growing legal or all growers freed.
No fixed cannabis gram threshold is inferred from this law.

## Partial consumption-chain reconstruction

Before this pass, the chart jumped directly from 1934 to 2024 and projected
modern consumption score 2 across the entire period. The directly compared
statutes now support three intervening consumption snapshots:

| Period / event | Consumption | Reason |
| --- | --- | --- |
| Before 1987 decree | 1 | Non-prescribed use was an administrative offence; the 1974 text already assigned authority over it. This is a legal classification, not evidence about prosecution frequency. |
| 1987 decree | 0 | Repeated use after an administrative penalty became a crime. |
| 1991 repeal | 3 | Use itself removed from both offences; possession remains restricted. No unrestricted public-use score is assumed. |
| 1995 public-use offence | 2 | Prison exposure for the specifically defined public/group conduct; private use remains distinct. This is the retained modern score, between illegal-use and private-use-only levels. |

The revised 1987 `before` carries consumption 1. The new 1991 `before` carries
0, and the new 1995 public-use `before` carries 3. All other components in those
snapshots preserve the inherited pre-medical vector. Existing 1934 and 2024
`before` objects and the current profile's six scores are unchanged.
Exact totals now read **100→20.5 (1934), →19.5 (1987), →22.5 (1991), →21.5
(1995), →22.5 (2024)**. The chart rounds them to 100→21→20→23→22→23.
The 1987 `unscored` reason is removed because consumption is now scored.

This is a **partial** reconstruction, not certification of the other five
historical components. The initial 1934 step still carries later restrictions.
The 1974 possession offence and the 1995 grow easing remain explicitly pending
in their `unscored` fields. In particular, do not project the 1995 administrative
cultivation tier through the 2001 replacement code and claim it explains the
2009 plant threshold without reading those original rules together.

The current consumption profile's old claim that public use was merely an
administrative offence is corrected to the defined criminal offence and actual
prison ranges. The other profile fields, sources and current scores are preserved.
The previous note's current possession fine, ordinary article 309 penalties and
small-grow boundary issues remain separate audit tasks.

## Follow-up leads rejected or left unfinished

An apparent 2000 repeal lead was checked: Law 1979-III concerns labour-payment
offences, not the small-possession repeat offence. It is not added to cannabis
history. The new code's commencement on 1 September 2001 appears in the official
catalogue, but its original drug-offence text was not retrieved in this pass.
The Rada English rendering differs from the Ukrainian text on at least one
cultivation threshold; it was not used to rewrite that threshold.

Further work: original pre-1974 criminal code; original 1984 administrative code;
1999 repeat-possession amendments; original 2001 drug offences; 2009 adoption vs
commencement and exact ten-plant boundary; current possession fine and sentencing
amendments. The broad coverage goal remains open.

## Validation

Production build passed: **4,089 pages**. The two articles have **414 and 407
words**, three sections each, and valid inline citations, country links and
related history targets. Source checks confirm exactly three additions and one
revised event, preserving every unrelated history object. Only consumption text,
its three new source records and the review date changed in the country profile;
all six current scores and every other existing profile field/source are preserved.

Rendered checks passed for **88 citation links**, numbered reference anchors,
tag pages, history links, clean history JSON/CSV and Ukraine's API. The exported
exact timeline matches all six expected points, ending at **22.5 (display 23)**.
`git diff --check` passed. The five-file commit is isolated from the unrelated
`source-archive.json` index and working-tree changes. The owned temporary site
build is deleted after validation; sources, extraction, rendered source page and
research helpers remain local.
