Romania’s top court upholds the distinction between possession and trafficking

The Constitutional Court rejected a challenge to the drug-trafficking offence in its pre-2023 form. It explained that possession for personal use remained a separate, lower-penalty offence, and that prosecutors had to prove the trafficking allegation. Drug use itself was not a separate criminal offence, while unauthorised possession remained punishable regardless of quantity.[1]
