Easing 🇷🇴 Romania

Romania's top court requires more than a drug test to convict a driver

From 28 January 2025, a driver in Romania commits the criminal drug-driving offence when a biological sample contains a psychoactive substance and that substance was capable of affecting the ability to drive. The High Court of Cassation and Justice decided the point on 27 January 2025, and the ruling became binding when the Official Gazette published it the next day. The court asks for that capacity. Proof that the driver made a mistake on the road sits outside what the prosecution must show. The sentence, set by a May 2024 amendment of the criminal code, is one to five years in prison and a ban on exercising rights, or two to seven years for public passenger transport, dangerous goods, a driving lesson or a driving test.[1][2]
