Portugal's Supreme Court confirms criminal liability above a ten-day personal supply

In judgment 8/2008, the Supreme Court of Justice resolved conflicting case law by holding that article 40(2) of the 1993 drug law remained applicable to acquisition or possession for personal consumption exceeding a ten-day supply. This included cannabis: exceeding the threshold could remain a personal-consumption crime, rather than automatically establishing trafficking. The ruling preserved the administrative regime for quantities within the decriminalisation threshold.[1]
