Juvani Swartbooi, sentenced to 12 months for dealing in 2021, asked the Windhoek High Court to strike down section 10's rule that holding more than 115 g of dagga presumes dealing unless the contrary is proved. Deputy Judge President Hannelie Prinsloo dismissed the application: dealing draws stiffer penalties than possession, a similar South African rule fell only in 1995, and the prosecution must still prove possession of at least 115 g beyond reasonable doubt — as Swartbooi's own admissions had established.[1]
