Honduras's criminal code replaces the 1989 drug penalties

Decree 46-2020 set 25 June 2020 as the day the criminal code commenced. Article 632(6) repealed articles 16 to 30 and 41 of the 1989 drug law, including the personal-consumption security measure. Article 311 now punishes sowing, cultivation, trafficking and possession for those purposes. Article 321 treats cannabis as a drug that does not cause grave harm, so the basic sentence is four to seven years, or one to three years when the circumstances show lesser gravity. The repeal does not declare that holding cannabis for oneself is lawful.[1][2]
