Tightening 🇫🇷 France

France promulgates sentencing floors for qualifying repeat offences

Law 2007-1198 introduced sentencing floors for legally defined repeat offences. For non-felony offences, the floors were one, two, three or four years where the statutory maximum was respectively three, five, seven or ten years. Courts could depart from the floors under specified conditions, with tighter rules for further recidivism. Cannabis cases therefore depended on the charge, its maximum penalty and the legal requirements for recidivism; the law did not impose a blanket minimum on every cannabis-use or possession conviction. The date is promulgation on 10 August, before publication on 11 August 2007.[1]
