President Noboa repealed the drugs table by Executive Decree 28 in November 2023. The National Court of Justice then issued Resolution 14-2023, instructing judges to assess each case individually to decide whether the substances were for personal use or trafficking. A 2025 reform of Article 228 of the penal code, in the Ley Orgánica de Solidaridad Nacional, leaves the personal-use parameters to the health ministry, the prosecutor's office and the judiciary council.[1]
