Read Tanzania's 2012 drug-law amendment

Add the 2012 Written Laws (Miscellaneous Amendments) (No.2) Act as a checked but unscored tightening event: mandatory life imprisonment for possession and trafficking, new sections 17A and 17B, and the retained small-quantity tier. Update the 1995 entry and article, and record the Zanzibar deferral decision in the follow-up note.

Tanzania replaces colonial drug laws and separates small personal-use offences

description

Tanzania's new drug law prohibited unauthorised cannabis growing, possession, supply and u … ious-plants and dangerous-drugs ordinances, took effect on 1 January 1996 and was amended in 2012 before its replacement in 2015.

unscored

Replaced the colonial ordinances but retained prohibition. The original text set life impr … ltivation with a 20-year maximum but kept life imprisonment for possession and trafficking, and the 2012 amendment made life imprisonment mandatory for both while retaining the small-quantity tier. The post-1926 vector is inherited from the old timeline, so a single-segment move would re-base the 2015 step without a full reconstruction.

+## The 2012 amendment
+
+The TanzLII consolidation's note that Act 6 of 2012 had not been applied sent the search to the
+Office of the Attorney General's document system, which holds the scanned Act Supplement. The
+**Written Laws (Miscellaneous Amendments) (No.2) Act, 2012 (Act 6 of 2012)** was passed on **16
+April 2012**, assented to on **15 June 2012** and published on **27 July 2012** in Act Supplement
+No. 6 to Gazette No. 30, volume 93. Part IX amends the Drugs and Prevention of Illicit Traffic in
+Drugs Act (Cap. 95).
+
+Section 31 replaces section 16(a) and (b) with mandatory sentences:
+
+> (a) found in possession or does any act or omits to do any act or thing in respect of narcotic
+> drugs or any preparation containing any manufactured drugs commits an offence and upon conviction
+> shall be sentenced to life imprisonment; and
+>
+> (b) trafficking in any narcotic drug or psychotropic substance commits an offence and upon
+> conviction shall be sentenced to life imprisonment.
+
+It also deletes section 16(2), the old use and premises offence. Section 32 adds two replacement
+provisions. Section 17A covers smoking, inhaling, sniffing or otherwise using a narcotic drug or
+psychotropic substance; being found without lawful excuse in a house, room or place used for those
+purposes; and possessing a pipe or other utensil for use with opium, cannabis, heroin, cocaine or a
+related substance. The penalty is a fine of one million shillings, ten years in prison, or both.
+Section 17B covers an owner, occupier or manager who permits premises to be used for preparation,
+manufacture, production or sale, or who possesses a tool, equipment, machine or utensil used in
+preparation; the penalty is life imprisonment. Section 30 narrows section 12(d) by deleting the
+words "manufactured drugs" and the phrase "or any preparation containing any manufactured drugs"
+from the prohibited-plant offence. Section 29 sends sections 12, 17 and 17A to a subordinate court
+and sections 16, 18, 19, 20, 21 and 23 to the High Court.
+
+The small-quantity personal-use tier in section 17 was not amended: cannabis still carried a
+200,000-shilling fine, seven years, or both. The 2012 Act therefore made life imprisonment
+mandatory for possession and trafficking, but did not create a new penalty level for those
+offences; the small-quantity tier still set a lesser custodial alternative. The inherited pre-2015
+vector already treats possession and supply as custodial prohibition, and a separate whole-point
+step would re-base the 2015 entry, whose 13 → 8 step is retained. The amendment is recorded as a
+checked but **unscored** event dated 27 July 2012.
+
+The existing [1995 article](../../articles/tanzania-illicit-traffic-act-1995.md) now mentions the
+2012 amendment, cites the new Act and links to the event. Its body remains 415 words and its five
+sources are all cited.
