Estonia makes small amounts a misdemeanour

description

A new penal code treats possession of a small quantity for personal use, later set at 7.5 g, as a misdemeanour punished by a fine.[@1, 2] The statute does not fix that quantity at 7.5 grams.[@3] A large quantity is enough to intoxicate at least ten people.[@3] A 2014 Supreme Court judgment records that 7.5 grams of marijuana at 7 to 10 per cent THC was treated as already enough.[@4]

+# Estonia quantity and Hong Kong cultivation, 23 October 2026
+
+Issues #43 and #44. Scores were left unchanged.
+
+## Estonia
+
+The English consolidation of the Act on Narcotic Drugs and Psychotropic Substances and Precursors thereof was read. Section 3-1(3) defines a large quantity as enough to cause drug intoxication to at least ten people. Section 15-1(1) punishes use without a prescription, and illegal manufacture, acquisition or possession of a small quantity, with a fine of up to 300 fine units or detention.
+
+The English Penal Code consolidation was read. A fine unit is 8 euros. Section 184(1) punishes unlawful handling of a large quantity with one to ten years. A group, a listed earlier offence, or handling for significant proprietary benefit can bring a longer sentence. Section 183 punishes systematic trafficking or mediation of a small quantity, possession of a small quantity in order to supply it, and taking a small quantity across the border, with a fine or up to three years. Section 188 still punishes illegal cultivation of cannabis with a fine or up to five years. That cultivation sentence was already in the profile and was left as it is.
+
+Supreme Court judgment 3-1-1-100-13 of 3 March 2014 was read. It records the lower court's finding that 7.5 grams of marijuana at 7 to 10 per cent THC is already enough to intoxicate ten people, and that a higher THC content means less plant material is needed. The judgment does not enact 7.5 grams as a statutory cutoff. Possession stays at 3.
+
+The European Parliament briefing named in the issue was not opened.
+
+## Hong Kong
+
+The Hong Kong Police Force narcotics penalty page was read. Cultivating any plant of the genus cannabis carries a fine of HK$100,000 and 15 years. Manufacturing a dangerous drug is listed separately, at HK$5 million and life imprisonment. The profile now states those as different offences. Cultivation stays at 0.
+
+The e-Legislation page for section 9 and the HKLII reproduction did not return the ordinance text, so the section number is not stated. The Community Legal Information Centre page and the Education Bureau PDF named in the issue were not opened.
