# Colorado gifts and plants, and District of Columbia growing, 23 October 2026

Issues #46 and #47. Sharing and cultivation scores were left where they were.

## Colorado

Colorado Revised Statutes section 18-18-406 was read in the 2025 Justia reproduction. Transferring not more than two ounces for no consideration is a drug petty offence and is not treated as a sale. A free transfer tied to payment for another service or product is a level 1 drug misdemeanour. Growing any marijuana plant is unlawful unless it falls within an exception. Lawful growing under article XVIII, section 16, in an enclosed and locked space, is one exception. More than twelve plants on a residential property is a separate offence: a first offence is a level 1 drug petty offence with a fine of up to $1,000. Growing outside the personal permission is graded separately. Six of those plants or fewer is a level 1 drug misdemeanour, and more than six, up to thirty, is a level 4 drug felony. Possessing more than two ounces, up to six ounces, is a level 2 drug misdemeanour, and more than six ounces is a level 1 drug misdemeanour.

The Colorado Legislative Council's 2018 marijuana handbook, which cites article XVIII, section 16, says a person 21 or older may give up to one ounce without remuneration to another person 21 or older, and may grow no more than six plants, three or fewer flowering, in an enclosed and locked space. The constitution PDF, the 2025 jury instructions, and the 2025 crime-classification guide named in the issue were not opened.

A gift up to one ounce remains lawful, so sharing stays at 5. Six plants per adult remain lawful, so cultivation stays at 4.

## District of Columbia

D.C. Code section 48-904.01 was read. A person 21 or older may grow no more than six cannabis plants, three or fewer mature, within the interior of the house or rental unit that is that person's principal residence. Everyone in that house or unit together may not grow more than twelve plants, six or fewer mature. The same section allows a transfer of one ounce or less, without remuneration, to another person 21 or older.

The Attorney General's Initiative 71 page describes growing inside the principal residence and says federal officers can arrest for any amount on federal property. That page's permitted-acts list does not restate the twelve-plant household ceiling, which is in the code section that was read. Cultivation stays at 4 and sharing stays at 5.
