Tightening 🇪🇸 Spain

Spain strengthens drug-trafficking penalties and confiscation powers

Organic Law 1/1988 revised the drug-trafficking offences, increased penalties and fines, expanded aggravated cases and confiscation, and criminalised knowingly benefiting from trafficking proceeds. It retained a distinction between substances legally classified as causing serious harm and other drugs. The same reform allowed conditional suspension of sentences of up to two years for qualifying offences driven by drug dependence, subject to treatment and other conditions. It addressed the broader drug framework without criminalising possession exclusively for personal consumption.[1]
