Hungary's constitutional court narrows drug diversion exemptions

In decision 54/2004, dated 13 December, the Constitutional Court ordered several diversion exemptions annulled on publication, including provisions covering offering or handing over drugs for joint consumption. It found the joint-consumption criteria too uncertain and also required legislation addressing the protection of minors. The ruling retained the exemption for small-quantity cultivation, production, acquisition or possession for personal use, conditional on six consecutive months of treatment, other drug-use assistance or preventive counselling certified before the first-instance judgment. It rejected the broader challenge to criminal penalties for personal cultivation and possession.[1]
