In Hassan v The State, the Supreme Court held that section 47(1) of the 1961 Act required proof that Indian hemp was prepared for smoking or was smoking residue. Finding leaves identified as Indian hemp did not establish that element. The court quashed the conviction, ordered acquittal and refused a retrial. The decision concerned the charge and evidence before it, rather than authorising every form of cannabis possession or supply.[1]
