A [US Virgin Islands early-history pass](research/history-usvi-early-gap-2026-10-26.md)
adds nine entries and two articles, reducing the 1937–2014 gap to a largest interval
of 19 years. It covers the 1951 tax-administration delegation, cannabis-warrant
search limits, the 1970 prison law, 1971 replacement drug law, 1990 licence penalties
and the 2011/2012 first-offender licence dispute, including the Supreme Court's
reversal. Current scores and existing historical vectors are preserved; earlier
territorial legislation and original commencement records remain research targets.

# US Virgin Islands: the 1937–2014 gap — 26 October 2026

Nine new entries and two articles extend the period between the existing 1937 tax
restriction and the 2014 reforms. The largest interval between dated entries falls
from 77 years to 19 years (1971–1990). The territory now has 23 entries.

## Guidance and scope

Read README, DATA-MAINTENANCE (history schema, scoring, workflow, source rules and
article guidance), WRITING, BOOKS, the existing 24 October USVI research memo,
existing profile and timeline. No applicable AGENTS file was found. Research is
limited to the territory's missing earlier history. Current profile scores, status,
and every existing historical score vector are preserved.

## Records actually read

- **Truman, Executive Order 10250, 5 June 1951**, original order reproduced by the
American Presidency Project. Read section 1(f), together with its delegation
introduction. It gives Interior the President's existing territorial registration
and tax powers, to be exercised in consultation with Treasury. This is an
administrative delegation, not the creation of a new tax or possession ban.

- **Government v. Rijos, 6 June 1968, 6 V.I. 475**, judicial opinion reproduced by
Legal Calculators. Read pp. 479–489 and final order, especially pp. 483–489.
The warrant sought cannabis following a named informant's purchases, but the
inventory and prosecution concerned heroin and other items. The judge upheld
probable cause for the warrant, suppressed evidence because of the unannounced
passkey entry and unlawful personal search, and separately rejected the challenge
to prosecution by information. No cannabis acquittal is inferred.

- **McIntosh v. People, 29 November 2012, 57 V.I. 669**, judicial opinion reproduced
by OpenJurist. Read facts, pp. 684–692, conclusion and notes on the schedules.
The court expressly dates the prison law to 13 February 1970 and commencement
of the replacement drug law to 23 March 1971. Cannabis was non-narcotic within
the latter but expressly included in the former's own definition. Three years
for introducing cannabis into prison was upheld; the case was remanded to stay
or dismiss one conviction because two convictions punished the same act. The
event is not a release or an acquittal. Its Schedule I discussion reports the
evidence before that court, not a new independent audit of all ministerial orders.

- **Bigby v. Government, 20 December 2000, 125 F. Supp. 2d 709**, judicial opinion
reproduced by Justia. Read pp. 710–716, conclusion and notes. Agreement plus an
overt act had to be alleged; conviction was vacated and a new trial ordered.
The omitted charge element is distinct from a finding that no act occurred.

- **People v. Rohn, 20 April 2011**, official Superior Court PDF, SX-03-CR-113.
Read relevant facts and statutory discussion, printed pp. 2–10, 12–14, 16–20.
It gives the 1971 purpose, possession/distribution maxima, first-offender
procedure, 1990 licence legislation, and its holding that revocation applied
even to first-offender probation. This interpretation was **reversed**; both
public entries and source locators state that subsequent outcome.

- **Rohn v. People, 21 November 2012**, official Supreme Court PDF, S. Ct. Crim.
No. 2011-0087, all ten pages. Header distinguishes consideration on 9 October
from filing on 21 November. The court reversed both the April interpretation
and the licence portion of the December 2011 order. Rohn had received six
months' probation without adjudication and the underlying case was dismissed
after completion. The first-offender provision had been enacted in 1971 and
the licence provision in 1990. Neither a plea nor probation is silently called
a conviction. No blanket repeal of licence penalties is claimed.

- **20 V.I.C. § 378, historical 2019 text**, statutory reproduction at Justia.
  Read (a)–(d). Confirms two-year possession and five-year other-drug penalties,
and the separate exception for the later civil-possession regime. The new
article uses this for the statute's structure, with the courts supplying its
  historical interpretation and application.
  https://law.justia.com/codes/virgin-islands/2019/title-20/part-ii/chapter-35/378/

Additional leads read but not used as primary public citations: USVI Public Records
code reproductions (titles 19 and 20), Eisenhower's 1957 update to the delegation,
and the current statutory reproduction of section 607. These consolidated texts
contain later amendments and cannot alone prove every original 1971 penalty.
Morton's 1978 case appeared in search results but its full text returned 403, so
it is not added as a checked event. Direct local downloads of several opinions
also returned 403; web extraction supplied the judicial text actually read.
PDF screenshot retrieval failed for both official Rohn PDFs; the dates and legal
history were checked in extracted headers and operative text, with cross-checks
between the two courts. No visual inspection is claimed.

## Scoring and follow-up

No new whole-segment change is manufactured from the number of entries. The 1951
administrative delegation, case-specific suppression, charging requirements and
interpretations leave the ordinary adult prohibition categories unchanged.
The 1970 offence concerns prison contraband. The 1990 penalty and 2012 relief
concern driving privileges; other defendants still faced criminal possession
penalties. These directional entries have explicit unscored explanations.

The 1971 replacement has an explicit provisional unscored explanation: recover
the preceding territorial drug chapter and original 1971 Act before assigning a
supported change across the six dimensions. First-offender relief is real, but
its existence does not by itself establish routine implementation or a newly
changed whole enforcement band. Original 1990 Act 5649 and its commencement
remain retrieval targets; the new entry records the verified adoption year.
The 1970 entry records adoption as described by the Supreme Court, without
claiming that a separate commencement notice was examined.

The inherited 1937 aggregate score step has not been re-certified by this pass.
A zero-flag chain check proves structural continuity, not that every earlier
segment was already at its later level. Original territorial restrictions,
1937 administration, pre-1971 law, the 1980s and the later retail/medical
implementation questions in the 24 October memo remain open.

## Verification

Both articles use all their sources inline, have four sections and 383/414 words,
and link to real history/profile destinations. The isolated candidate contains
exactly the nine new entries; every HEAD history object and score vector is
preserved. A test fixture combines HEAD with this batch, excluding other chats'
unfinished article and history edits: **history tests 40/40 pass**. The initial
live run found one unrelated article citation still being edited; its output
is retained rather than reported as a clean run. **Quick-answer tests 27/27 pass**.
The production build passed with **4,268 pages**. Chain check: zero flags;
triage: three scored steps, zero open territorial entries.

A background browser verified the country History tab shows all 23 entries,
including the nine additions, and the 2012 article renders the reversal date,
headings, inline citations and references. Build detail pages and history CSV
are checked separately. Current score remains 33. Research downloads, candidate,
test fixture and logs live under ignored `tmp/history-usvi-early-2026-10-26/`.
The commit excludes unrelated changes and source-archive staging.
