### French Polynesia's 1978 framework and research exceptions (26 October 2026)

Recovered the original 1978 poisonous-substances deliberation and executable order
from Lexpol's gazette scan. Added an explicitly adoption-dated cannabis prohibition
entry and an article explaining possession, medical THC, research exceptions and
seizure destruction. The 2022 possession and 2023 cultivation permissions for the
Institut Louis Malardé now have separate research entries, checked against an
official retrospective account. The recorded 1925-estimate-to-2023 gap falls from
98 to 53 calendar years. Earlier restrictions and precise commencement remain
unresolved; no score or profile change. The original preamble supplies new 1924,
1937, 1955 and 1971 research leads. See
`docs/research/history-french-polynesia-1978-2026-10-26.md` for sources, dates and limits.

# French Polynesia: the 1978 framework and research exceptions

Research date: 26 October 2026. Read `docs/DATA-MAINTENANCE.md`, `docs/WRITING.md`
and the local-book research guidance before this pass.

## Gap and changes

The largest interval in the existing post-1800 French Polynesia timeline ran from
its unresolved 1925 first-restriction estimate to the January 2023 medical-law entry:
98 calendar years. Adding the 1978 adoption reduces that recorded interval to 53
calendar years, with a further 44-year interval to the 2022 research permission.
These are distances between recorded events, not proof of uninterrupted legal regimes.

Added three checked, unscored events and one 396-word article:

- `french-polynesia-cannabis-prohibition-adopted-1978`: 18 August adoption;
- `french-polynesia-research-possession-permission-2022`: 30 March authorisation;
- `french-polynesia-research-cultivation-permission-2023`: 9 March authorisation.

The research events are culture/science context entries. They give one institute
specific permissions and establish no ordinary patient or adult access. The first
restriction estimate, country profile and all scores remain unchanged.

## Primary text recovered and read

The pharmacists' professional council links to Lexpol's record for deliberation
78-137. That index incorrectly displays 13 August; the gazette and Lexpol's own
record establish 18 August. Lexpol failed in the web reader but downloaded directly.

- Record: https://lexpol.cloud.pf/LexpolAfficheTexte.php?texte=201417
- Original gazette: https://lexpol.cloud.pf/document.php?document=189651&deb=861&fin=870
- JOPF 28, 15 September 1978, pp.861–870 (ten PDF pages).
- Read preamble, executable order, articles 1, 17–18, 21–24, 41–43, 65–67;
visually checked printed pp.861, 863, 866 and 870 against the scan.

Article 18 prohibits import/export, production, commerce, use and possession of
Indian hemp and preparations; its botanical definition refers to female flowering
and fruiting tops. Its research exception requires a government-council order on
the public-health director's proposal. Article 42 in the original medical chapter
already prohibits THC isomers and derivatives, with a research exception. This
claim is therefore not inferred backwards from the 2024 consolidation. Article 66
requires destruction of cannabis seized over an article-18 offence.

The date is explicitly **adoption**, not asserted commencement: 18 August adoption,
4 September executable order, 15 September publication. Lexpol's earliest available
consolidated version is dated 15 September. Neither an adoption nor an executable
order alone proves when each prohibition first became enforceable against a person.
No new score step is inferred from this sequence.

## Later official accounts

- Assembly health-committee report, distributed 28 October 2022:
  https://www.assemblee.pf/travaux/downloadTexte/1555822
Read report pp.2–4, especially the account of existing restrictions, absence of
therapeutic/hemp exceptions and reasons for a replacement framework.
- Competition Authority opinion 2024-AO-01, 31 January 2024:
  https://autorite-concurrence.pf/wp-content/uploads/2024/02/Avis-n2024-AO-01-du-31-janvier-2024-Cannasbis-V.Def_.pdf
Read printed pp.4–5, paragraphs 15–27 and footnotes; visually checked p.5.
Footnote 10 identifies presidential orders 248 PR (30 March 2022, possession)
and 196 PR (9 March 2023, possession and cultivation). Paragraphs 25–27 describe
police samples, imported varieties, controlled containers and later results.
The source is a retrospective official account; no exact date is assigned to
sample handovers, planting or findings. The description attributes results to
January 2024 rather than treating them as achieved on the authorisation date.

## Other documents checked and limits

Downloaded and extracted UN E/NL.1987/21–23 (five pages), circulated 5 April 1989:
https://digitallibrary.un.org/record/75150/files/e-nl-1987-21-23-f.pdf
The preambles on pp.2–3 corroborate the 4 September 1978 executable order. Their
operative changes concern other drugs, so no cannabis event was added for 1986.

Also recovered the original order 953 S of 15 December 1978 and its medical
schedule: https://lexpol.cloud.pf/document.php?document=189683&deb=489&fin=493
Lexpol record: https://lexpol.cloud.pf/LexpolAfficheTexte.php?texte=197722
The scan is JOPF 21 NS of **8 June 1979**, pp.489–493, with cannabis/resin on
p.491 and THC later in the tables. Read the order and relevant schedule passages.
Its signature/executable date and later publication differ; no effective-date
claim or separate cannabis scheduling step was inferred.

An attempted Institut Louis Malardé 2022 annual-report PDF URL returned HTML,
so its indexed snippet supplies no checked claim or public citation here.

## Remaining larger-gap leads

The 1978 preamble names the **4 January 1924** decree regulating poisonous
substances in the French Establishments in Oceania, a 19 April 1926 pharmacy
decree, a 9 November 1937 substances decree, the 1954/1955 extension of health
legislation (local promulgation 30 September 1955), and the 1970 drug law (local
promulgation order 407 AA, 5 February 1971). These are primary-text leads, not
proof that the 1924 decree was the first cannabis restriction. Recover their
original schedules, amendments and local publication before replacing the estimate.
The 1924 and 1937 instruments are the best next leads for the remaining 53-year gap.

## Validation

History scope tests: 40 passed. French Polynesia score-chain audit: zero flags,
unchanged 100 → 11 estimated first step. Full isolated Astro build and generated
page/citation checks are recorded in the batch's ignored temporary directory.
