# Thailand: the 1979 Act and its 2021 replacement

Reviewed 27 October 2026 after reading maintenance, writing, article guidance and the earlier Thailand pass in `history-1980s-2000s-2026-10-17.md`. The preceding goal turn was progress: the Korea original-law review and article were committed. This pass fills Thailand's highest-ranked missing article and a missing replacement-law event for a country of roughly 72 million people.

## Sources actually read

- **Original Narcotics Act B.E.2522 (1979)**, Thai FDA: https://narcotic.fda.moph.go.th/law-type/na-02-1-2522 . Reopened the official page and its PDF viewer, then read the existing downloaded original `tmp/history-2000s-2026-10-17/th1979.pdf/.txt`. Attachment ID 499135076869742592. Read sections 2–4, 7–8, 26, 57, 75–76, 92 and the explanatory note. Signed 22 April; Gazette 27 April; next-day commencement. Original category 5 possession: up to five years AND up to 50,000 baht; possession for distribution and production/distribution/import/export: two to fifteen years AND 20,000–150,000 baht. Original use: up to one year AND 10,000 baht. Section 26 presumes possession for distribution at ten kilograms; this is the original rule, not the present Code. Definitions include cultivation within production and giving within distribution. Section 3 repeals seven laws, including the Cannabis Act B.E.2477, published in 1935. The explanatory note invokes outdated provisions, more effective controls and treaty consistency.
- **Act Promulgating the Narcotics Code and annexed Code B.E.2564 (2021)**, original Thai Gazette, 80 pages: https://narcotic.fda.moph.go.th/law-type/na-10 . Followed the viewer's attachment ID 498847832757903360 and downloaded the PDF successfully to `tmp/thailand-1979-2021/code-thai.pdf`; extracted text alongside it. Read promulgating Act sections 2–4, 8–10 and 23; Code sections 29, 93, 104, 107, 113–114, 162, 164–165 and the explanatory note. Gazette vol.138 part73a dated 8 November; the Act takes effect next day and the Code after thirty days, yielding 9 December 2021. Section 4 expressly repeals the 1979 Act and its amendments; section 8 continues compatible subordinate rules and section 9 qualifies provisions needing new regulations. Category 5 controls continue under section 93. Sections 107/164 create distinct personal-use possession exposure of up to two years OR 40,000 baht OR both; sections 104/162 address consumption with up to one year OR 20,000 baht OR both, subject to exceptions. Section 113 requires voluntary treatment before detection, compliance with prescribed conditions and written satisfactory-completion certification to remove liability. Section 114 addresses qualifying referrals following detection. Section 165 lets courts prioritise treatment and consider individual circumstances. These are statutory routes, not proof of typical sentencing practice or automatic immunity for small amounts. English wording in the articles is a paraphrase of the cited Thai text.
- **Tilleke & Gibbins, 13 June 2022**, read the contemporaneous legal analysis: https://www.tilleke.com/insights/thailand-removes-cannabis-from-the-narcotics-list-whats-next-for-the-industry/ . Confirms the 2019 medical opening, the previous licensing regime and the 9 June 2022 change distinguishing plant material from specified extracts. Used for that historical context, not present-day advice.

## Applied

- Added `thailand-narcotics-code-2021`, easing, checked, with explicit `unscored` explanation and links to 1979, medical opening and 2022. This records changed personal-use penalties/treatment without claiming adult-use legalisation in 2021.
- Wrote articles for both `thailand-narcotics-act-1979` and `thailand-narcotics-code-2021`, connecting the separate cannabis statute, unified drug regime, replacement Code and later removal from the narcotics list. The original 1979 event was already corrected in the October 18 pass and its existing scores/date are preserved.
- No profile or before-score changes. Both the old amended Act and new Code leave ordinary unlicensed use/possession criminal within the inherited low bands; the reviewed sources do not establish fine-led practice or an operational adult-use source sufficient to alter the numerical index.

## Retrieval limits and next leads

The ONCB English-PDF address returned an HTML page, not the indexed translation. The AIPA reproduction returned 404. Neither is cited as a document read. The original Thai Gazette from FDA was successfully read instead. The Egypt 1980 Bulletin address returned 404 and was not used. Barbados's original 1936 law and Austria's original 1928 implementation remain gaps documented in earlier notes, not filled with assumptions.

Thailand's 2003 drug war is another substantial missing context event. Initial HRW and Amnesty leads explicitly describe a methamphetamine-focused campaign and general drug suspects. A cannabis-specific connection and careful scope check remain necessary before applying the reported general death toll to cannabis history or scores; no such inference was inserted in this pass.

## Validation and archive check

43 history tests and 69 profile/answer tests pass. Thailand's five scored steps report zero flagged transitions; the new 2021 event is explicitly unscored. Full build passes: 4,490 pages. Browser checks confirm the 9 December 2021 heading, original 1979 penalty text, numbered sources and cross-links; article bodies are 351 and 352 words.

A focused run of the repository archive-check script, writing its own temporary index to avoid the concurrently active global save worker, found an existing [19 May 2026 capture of the Code source page](https://web.archive.org/web/20260519094925/https://narcotic.fda.moph.go.th/law-type/na-10). The 1979 FDA page already has a recorded capture. No new save request was necessary. The new Code capture is recorded here pending the global index's next refresh; the active worker's file was not overwritten.
