title

Italy stops punishing aenacts an exception for modest quantitypersonal-use quantities

description

Law 685 distinguished users from dealers for the first time. Holding a "'s Article 80 made illicit purchase or possession of modest quantity"quantities for non-therapeutic personal use was not non-punishable, though thewhile requiring seizure and confiscation. It also provided a therapeutic-use exception and retained treatment and judicial procedures. Sharing and cultivation remained subject to separate controls. The law never said how much that was dated 22 December and took effect on publication on 30 December; it set no fixed gram threshold for the modest-quantity exception.

# Italy's 1975 personal-use exception — 20 October 2026

Added an article and clarified the existing 1975 event. No separate event was
created for other provisions of the same instrument.

## Evidence and limits

- Read the official original-text HTML for Articles 12, 26, 71–72, 80, 95–98
and 108. Visually checked Article 80 against the original gazette at printed
  p. 9164 (PDF p. 20), Articles 97–100 at p. 9167 (PDF p. 23), Article 101
  at p. 9168 (PDF p. 24), and Article 108 and signature at p. 9169 (PDF p. 25).
Also inspected printed p. 9165, including treatment organisation. Other gazette
pages were not treated as read simply because the whole file was downloaded.
- Article 80 distinguishes therapeutic need, modest non-therapeutic quantities
and substances already used exclusively personally. Its confiscation and
Title XI provisions were retained in the account. It was not described as a
legal retail market, right to retain drugs or general cultivation permission.
- Article 98 supplies an expert-assessment procedure, not a fixed gram limit.
Article 12 distinguishes cannabis products from THC; the article does not
place every cannabis-derived substance in Table II without qualification.
- Articles 95–101 combine voluntary treatment/anonymity with reporting and
judicial powers. The account does not describe all treatment as voluntary.
- Article 108 verifies both commencement on publication (30 December) and
repeal with the central-office exception. The existing event retains the
22 December instrument date; its title now expressly describes enactment.
- The original 1954 Article 6 was read in the preceding pass and supports the
comparison. The existing secondary and 1977 court citations were retained,
but are not newly verified sources or the basis of this article. All new
claims rest on actual primary text, not search-result summaries.
- No empirical enforcement or treatment-access claims were inferred. No
country profiles, scores or score baselines changed. Every existing score
vector is preserved without fresh validation.

## Verification

Baseline: `tmp/history-italy-1975-2026-10-20/changes-before.yaml` (ignored).
Check record preservation except the planned title, description and source
addition; validate article metadata, word count and links; build and inspect output.
