# State possession, gifts and home growing — 23 October 2026

Issues #49 to #57. Scores were left as they were. State events were not given national `before` scores.

## Maryland (#49)

Criminal Law §5-601.2: two plants per person and per residence; plants out of public view; reasonable precautions, including an enclosed locked space; property consent; under 21 may not cultivate; a violation is a misdemeanour of up to three years or a fine of up to $5,000, or both.

Alcoholic Beverages and Cannabis §36-302(b): a qualifying patient at least 21 may not cultivate more than four plants. Two or more qualifying patients at one residence may not cultivate more than four there. They still follow §5-601.2 except for those plant numbers.

The Cannabis Administration FAQ says a person 21 or older may cultivate two plants, a household two, and a registered medical patient two additional plants, for a total of four, not more than four at a residence. Landlords may prohibit growing. The FAQ also states the 1.5-ounce personal-use amount. The $250 civil bands already in the possession and consumption lines were not re-read.

Cultivation stays at 3.

## Vermont (#50)

18 V.S.A. § 4230a, including the 2026 session and effective 1 July 2026: a person 21 or older who possesses two ounces or less, or 10 grams of hashish or less, and two mature plants or fewer or four immature plants or fewer, is not penalized. The two-ounce and 10-gram limits do not include cannabis cultivated, harvested and stored under § 4230e. That section was not opened.

§ 4230(a)(1) and (a)(2) both describe knowing unlawful possession of more than two ounces. Subsection (1) is a civil penalty of not more than $100, $200 or $500. Subsection (2) offers Court Diversion on a first offence and, on conviction, not more than six months or a fine of not more than $500, or both. Subsection (3) is eight ounces, or more than four mature or eight immature plants, and not more than three years. Subsection (4) is more than one pound and not more than five years. Subsection (5) is more than ten pounds and not more than fifteen years.

§ 4230(b)(4): a person 21 or older may dispense one ounce or less, or five grams or less of hashish, to another person 21 or older, if the dispensing is not advertised or promoted to the public. Unlawful selling is not more than two years. Selling or dispensing more than one ounce, or five grams or more of hashish, is not more than five years. The bill-status page for S.278 was not opened. The statute annotations supply the 1 July 2026 effective date. No history entry was added, because the previous ounce figures were not read in the bill.

Sharing stays at 5. Possession stays at 5. Cultivation stays at 4.

## Oregon (#51)

The legislature's ORS chapter page did not load. The 2025 Justia reproductions of §§ 475C.305 and 475C.345 were read, and the Oregon Health Authority page.

§ 475C.305(7) is delivery of not more than one ounce of usable marijuana at a time, adult to adult, for noncommercial purposes. Subsections (8) to (10) are 16 ounces solid, 72 ounces liquid, and 16 ounces of concentrate. Subsection (2) is eight ounces of usable marijuana at a household. Subsection (1) is four plants at a household. The Health Authority page states two ounces in a public place and eight ounces at home.

§ 475C.345(3)(a): a Class B misdemeanour when an adult 21 or older unlawfully delivers usable marijuana, for no consideration, to another adult, and the amount is not more than twice the one-ounce amount in § 475C.305(7). The sentence "From four to eight is a misdemeanour" was already in the cultivation line and was not re-read.

Sharing stays at 5.

## New Mexico (#52)

§ 26-2C-25(A)(9), 2025 Justia text: six mature and six immature plants per person, and no more than twelve mature plants in one household. Cannabis produced inside that plant limit may be possessed despite weight limits.

§ 26-2C-27(B): a person 21 or older who intentionally produces more than six and up to twelve mature or immature plants receives a $50 penalty assessment. More than twelve mature or immature plants is a fourth-degree felony. The sentencing statute for that felony was not opened. The personal allowance of six plus six and the $50 band both use the words "more than six" and "twelve". The profile states both.

The Regulation and Licensing Department page says one adult may grow up to twelve plants, no more than six mature, and a household no more than twelve mature, with penalties from a $50 fine to a fourth-degree felony.

The possession line "From 2 to 8 oz in public is a misdemeanour" was not re-read. Cultivation stays at 4.

## Maine (#53)

Title 28-B, §1501(1)(E) and §1502, as amended by Public Law 2023, chapter 220: six mature plants, twelve immature plants and unlimited seedlings for a person 21 or older, on land where the person is domiciled, land the person owns, or another person's land with written permission. Plants must not be visible from a public way. Each mature and immature plant needs a tag. A municipality may cap plants on a parcel only if each domiciled adult may still grow the statutory numbers.

The Office of Cannabis Policy FAQ states the same six, twelve and unlimited seedlings. The August 2023 Cannabis 101 PDF says the six-mature rule is effective in late 2023. It does not give a calendar day, and the chapter page that would carry the effective date returned 404, so no history entry was added. A year-only date would be read as 1 July.

§1501(1)(B) and (C) confirm 2.5 ounces for possession and for an unpaid transfer. The existing "2.5 to 8 oz" crime sentence was not re-read. Cultivation stays at 4, which already covers a handful of three to six plants.

## New York (#54)

The Senate HTML pages timed out. The text was read on New York Public Law, which attributes §§ 222.15, 222.25 and 222.30 to the Senate site and marks them verified on 17 October 2026.

§ 222.15: three mature and three immature plants per person, and no more than six mature and six immature within a private residence or its grounds. Up to five pounds may be possessed at that residence, kept secure from anyone under 21. Personal cultivation is only at the private residence.

§ 222.25: more than three ounces, or more than 24 grams of concentrate, is a violation punishable by a fine of not more than $125.

§ 222.30: more than sixteen ounces, or more than five ounces of concentrate, is a class A misdemeanour.

The Office of Cannabis Management page states the same per-adult and per-household plant numbers, including when three or more adults live there, and the three-ounce and 24-gram possession amounts. The sharing line was not re-read. Cultivation stays at 4. Possession stays at 6.

## Rhode Island (#55)

Public Law 2022, chapter 32, § 21-28.11-22: a person 21 or older may possess one ounce or less, up to ten ounces at the primary residence if the commission's security requirements are met, and a dwelling may have three mature and three immature plants no matter how many people live there. An unpaid gift of up to one ounce to another person 21 or older is protected if it is not advertised or promoted to the public.

The same act's amendment of § 21-28-4.01(c)(2) shows deleted and inserted text together. The inserted civil rule is more than one ounce and not more than two ounces, for a person at least 21, a $150 civil penalty and forfeiture for a first or second violation within 18 months, and not any other criminal punishment. The inserted misdemeanour for more than two ounces, and for more than ten ounces in the residence, is up to one year. The 2026 FindLaw codification was not opened. The Department of Health page confirms one ounce on the person, ten ounces at home, and three mature and three immature plants.

Possession stays at 6.

## Connecticut (#56)

§ 21a-279a(a), 2025 Justia text: 1.5 ounces, and five ounces in a locked container at the residence or a locked glove box or trunk. On and after 1 July 2023, the personal possession limit does not include a live plant or cannabis plant material derived from a live plant the person cultivated under § 21a-278c.

Subsection (d): over that limit but under five ounces, and under eight ounces in the locked container, is a $100 fine the first time and $250 after that. Subsection (e): five ounces or more, or eight ounces or more locked, is a $500 fine the first time and a class C misdemeanour after that.

§ 21a-278c: up to three mature and three immature plants in the consumer's primary residence, secure from anyone else, and no more than twelve plants per household. The cultivation line's "written warning" was not in this section and was left as it stood. Possession stays at 6.

## Oklahoma (#57)

§ 63-427.6(H)(3): any person who shares less than three grams of medical marijuana with an unauthorized person, without value or other consideration, shall not be subject to criminal prosecution and shall be subject to an administrative fine of $400. The regulation at 442:10-2-9 repeats that rule for a licensed patient and a licensed caregiver.

2026 OK CR 11, committee comments to OUJI-CR 6-2: ordinary unlawful distribution includes unpaid sharing, and conduct within § 427.6(H)(3) cannot constitute distribution under § 2-401(A)(1).

§ 2-401(B)(2): unlawful distribution of marijuana is a Class D1 felony. The imprisonment range in Title 21 was not opened, so the profile does not state a term of years for that felony. § 2-401(E): using a person under 18, or distributing to a person under 18, is a Class C1 felony of two to ten years, then four to twenty, then ten years to life. The old "two years to life" line was that minor-related range, not the ordinary marijuana offence.

Sharing stays at 1. The under-three-gram rule is an administrative fine, not a lawful gift.
