In case 3 Tdo 52/2008, the Supreme Court quashed an appeal decision against a woman growing cannabis for therapeutic preparations and returned the case for reconsideration. It rejected the offence classification used below and found that the specific treatment circumstances could lack the social harmfulness required for a crime. The ruling did not create a general medical-cannabis licence or prevent other production or possession offences from applying in different cases.[1]
