Constitutional Judgment 11/2000 rejected a challenge to Articles 108 and 109 of Law 1008 as amended by the 1996 sworn-bail law. The applicant argued that restrictions on preliminary issues and provisional release violated the presumption of innocence and defence rights. The Tribunal held that the procedural provisions did not contradict that presumption and also found the challenge insufficiently explained. The ruling preserved the challenged framework; it did not abolish provisional release altogether or identify the drug involved in the applicant's case.[1]
